摘要数据伦理框架作为国外数据治理体系的重要组成部分，在提升数据治理效能、优化数据治理模式等方面具有重要作用。欧美国家已经建立了相对成熟的数据伦理框架，对其基本架构和深层逻辑的探讨可以为我国数据伦理框架的构建提供重要参考，对我国数据治理体系的现代化也具有重要意义。通过文献调研法和内容分析法，对8个国外数据伦理框架进行比较，研究国外数据伦理通用的框架、结构和运行模式，借鉴国外数据伦理框架的模式及实践经验，对我国数据伦理框架参与国际数据伦理对话以及中国化构建路径进行了探索性研究。国外数据伦理框架相对稳定，并具有规律性，确立了以法律体系为支撑、以基本原则为核心、以行动方案为指南的数据伦理逻辑框架，形成了“法律体系—伦理框架—伦理说明”为一体的以伦理问题为中心的运行机制。
